1. ACCEPTANCE AND BINDING AGREEMENT

BY ACCESSING, USING, OR REGISTERING FOR INKCRAFT AI ("SERVICE", "PLATFORM", "APPLICATION"), YOU ("USER", "YOU", "YOUR") UNCONDITIONALLY ACCEPT AND AGREE TO BE LEGALLY BOUND BY THESE TERMS AND CONDITIONS ("TERMS", "AGREEMENT") AND ALL POLICIES REFERENCED HEREIN, INCLUDING OUR PRIVACY POLICY AND COOKIE POLICY.

IF YOU DO NOT AGREE WITH ANY PART OF THESE TERMS, YOU MUST IMMEDIATELY DISCONTINUE USE OF THE SERVICE.

2.2 AI Technology Disclaimers

YOU ACKNOWLEDGE AND AGREE THAT:

• AI-generated content is inherently unpredictable and variable
• Results may not meet your expectations or requirements
• The Service cannot guarantee specific outcomes or quality levels
• AI algorithms may produce biased, inappropriate, or inaccurate content
• Generated designs may inadvertently resemble existing copyrighted works
• Technical limitations may affect output quality and availability

2.3 Service Availability

• We provide the Service on an "AS IS" and "AS AVAILABLE" basis
• We do not guarantee 24/7 availability or uninterrupted service
• Scheduled and unscheduled maintenance may occur without notice
• We depend on third-party services which may experience outages
• Geographic restrictions may apply

3. USER CONTENT AND INTELLECTUAL PROPERTY

3.1 User-Generated Content Responsibilities

BY UPLOADING, SUBMITTING, OR PROVIDING ANY CONTENT TO THE SERVICE, YOU REPRESENT, WARRANT, AND COVENANT THAT:

• You own all rights, title, and interest in the content OR have obtained all necessary licenses, permissions, and releases
• You have the legal right to grant the licenses set forth in these Terms
• The content does not violate any third-party rights, including copyright, trademark, privacy, or publicity rights
• You have obtained all necessary consents from any individuals depicted in images
• The content is not defamatory, obscene, pornographic, abusive, or otherwise objectionable
• The content does not contain viruses, malware, or other harmful components

4. PAYMENT TERMS AND REFUND POLICY

4.1 Digital Products - No Refund Policy

ALL SALES OF DIGITAL PRODUCTS, CREDITS, AND SUBSCRIPTIONS ARE FINAL. WE DO NOT OFFER REFUNDS, RETURNS, OR EXCHANGES FOR DIGITAL CONTENT OR SERVICES.

4.2 Subscription Billing

• Subscriptions renew automatically until cancelled
• You may cancel your subscription at any time through your account settings
• Cancellations take effect at the end of the current billing period
• No partial refunds are provided for unused subscription time

4.3 Credit System

• Credits are non-transferable and non-refundable
• Credits do not expire unless your account is terminated
• Credit usage is final and cannot be reversed

5. LIMITATION OF LIABILITY

5.1 Maximum Liability Cap

UNDER NO CIRCUMSTANCES SHALL INKCRAFT AI'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE INCIDENT GIVING RISE TO LIABILITY.

5.2 Exclusion of Consequential Damages

WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

6. TATTOO-SPECIFIC DISCLAIMERS

6.1 Medical and Health Warnings

YOU ACKNOWLEDGE AND AGREE THAT:

• Tattooing involves inherent medical risks including infection, allergic reactions, and scarring
• You must consult with qualified medical professionals before getting any tattoo
• We are not responsible for any medical complications arising from tattoo application
• You must disclose all medical conditions and medications to your tattoo artist

6.2 Cultural Sensitivity and Appropriation

You are solely responsible for:

• Researching cultural significance of design elements
• Avoiding inappropriate cultural appropriation
• Respecting religious and traditional symbols
• Understanding potential social and cultural implications

7. LEGAL JURISDICTION

7.1 Governing Law

These Terms are governed by and construed in accordance with the laws of Italy, without regard to conflict of law principles.

7.2 Jurisdiction

Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Italy.
